This Subscription Cancellation Policy ("Subscription Policy") governs all recurring-subscription, auto-renewal, and "Subscribe & Save" (collectively, the "Subscription") purchases made through the Site. This Subscription Policy is designed to comply with the U.S. Restore Online Shoppers' Confidence Act (ROSCA — 15 U.S.C. §§ 8401–8405), the U.S. Federal Trade Commission Act § 5, the California Automatic Renewal Law (Bus. & Prof. Code §§ 17600–17606) and equivalent state automatic-renewal statutes (including those of New York, Illinois, Oregon, Colorado, Connecticut, Virginia, and Vermont), and applicable EU/UK distance-selling and consumer-protection rules where the Subscription is offered to non-U.S. consumers.
By enrolling in a Subscription, you acknowledge that you have read, understood, and expressly agreed to the terms of this Subscription Policy, which is incorporated into the PawHerb Terms of Service and Refund & Return Policy by reference.
A PawHerb Subscription is a recurring-purchase program under which the customer authorizes PawHerb to ship a designated PawHerb product (or product bundle) at a stated cadence (e.g., every thirty (30), forty-five (45), or sixty (60) days) and to charge the customer's designated payment method for each shipment until the customer cancels.
Enrollment in a Subscription is entirely voluntary and is offered as an alternative to one-time purchases. Customers may instead place one-time orders without enrolling in any Subscription.
2.1 Affirmative Consent. Subscriptions are activated only upon the customer's express, affirmative action at checkout (e.g., selecting a "Subscribe & Save" option and then completing the purchase). PawHerb does not enroll customers in Subscriptions by default, by pre-checked boxes, or as an undisclosed condition of any one-time purchase.
2.2 Recurring-Charge Authorization. By enrolling in a Subscription, you expressly authorize PawHerb (and its third-party payment processors) to automatically charge your designated payment method for the Subscription product price, applicable taxes, and shipping fees on the recurring billing date corresponding to your selected cadence, until you cancel in accordance with Section 7. You acknowledge that the Subscription will continue and be billed automatically each cycle until cancelled — there is no end date.
2.3 Disclosures at the Point of Sale. Before completion of the Subscription enrollment, the following material terms are clearly and conspicuously disclosed to the customer:
2.4 Acknowledgment. Promptly following enrollment, PawHerb sends a confirmation email containing a written summary of the foregoing disclosures and instructions for cancellation, in compliance with the California Automatic Renewal Law and equivalent state requirements.
3.1 Cadence. The first Subscription charge is processed on the date of enrollment (or upon shipment of the first order, as disclosed at checkout). Each subsequent charge is processed on the recurring billing date corresponding to the selected cadence — typically every thirty (30) days for a monthly Subscription.
3.2 Charges. Each Subscription charge will be billed in U.S. Dollars to the payment method on file and will include the product price, applicable taxes, and shipping fees as disclosed at enrollment or as updated under Section 12.
3.3 Payment Method on File. It is the customer's responsibility to keep payment-method information current. Customers may update payment information at any time through their account portal or by contacting hello@mypawherb.com.
Subscription prices are typically discounted relative to the one-time purchase price; the applicable discount is disclosed at enrollment. Where a Subscription is enrolled under a promotional introductory offer (e.g., a discounted first shipment or a free-trial period), the following will be conspicuously disclosed before enrollment: (a) the duration of the introductory period; (b) the date on which the introductory period ends; (c) the price that will apply after the introductory period; and (d) instructions for cancellation prior to the start of the first non-introductory billing cycle.
Where required by applicable state law (including, without limitation, California for Subscriptions of more than thirty-two (32) days made without express affirmative consent for each renewal), PawHerb will send the customer a reminder notice prior to the renewal charge that includes (a) the fact that the Subscription will automatically renew unless cancelled, (b) the renewal date and amount, and (c) instructions for cancellation. PawHerb may, in its discretion, provide such reminders for all Subscriptions as a customer-service practice.
You may cancel your Subscription at any time, for any reason or no reason, with no cancellation fee, no termination penalty, and no obligation to provide a justification. This right is permanent and applies for the entire duration of the Subscription, beginning immediately upon enrollment.
PawHerb does not impose minimum-term commitments, lock-in periods, or "early-termination" charges on Subscriptions.
Consistent with the FTC's "click-to-cancel" expectations, PawHerb provides cancellation mechanisms that are at least as simple as the enrollment mechanism. You may cancel a Subscription by any one of the following methods:
No additional steps, retention offers, surveys, or "winback" workflows will be imposed as a precondition to cancellation. PawHerb may offer alternatives (such as pausing or changing cadence — see Section 11) at the customer's option, but the customer's right to cancel will be honored without delay regardless of whether such alternatives are accepted.
Upon receipt of a valid cancellation request, PawHerb will send a written confirmation (typically by email) within a reasonable period, generally within twenty-four (24) to forty-eight (48) hours.
8.1 Effect of Cancellation. Cancellation takes effect immediately upon PawHerb's receipt and processing of the request, and prevents future Subscription charges and shipments.
8.2 Cancellations Made Before the Next Billing Cycle. To prevent the next scheduled charge, the cancellation request should be received by PawHerb at least forty-eight (48) hours before the next scheduled billing date.
8.3 Cancellations Made After Charge Processing. If a Subscription charge has already been processed at the time of cancellation:
8.4 No Recurring Liability. Once cancellation has been processed, the customer has no ongoing payment obligation under the Subscription.
Refunds for Subscription orders are governed primarily by the PawHerb Refund & Return Policy (Document III). In summary:
If a Subscription charge is declined or otherwise fails:
In addition to cancellation, customers may, through their account portal or by emailing hello@mypawherb.com:
Modifications are subject to the same forty-eight (48)-hour cutoff before the next billing date as cancellations.
PawHerb may modify Subscription pricing, cadence options, or other material terms from time to time. Material changes — including any increase in the per-cycle price — will be communicated to active subscribers by email at least thirty (30) days before the change takes effect, with clear instructions for cancelling before the new terms apply, in accordance with applicable automatic-renewal statutes. Continued participation in the Subscription after the effective date of the change constitutes acceptance of the revised terms.
PawHerb reserves the right, in its sole discretion, to terminate a Subscription at any time, including for: (a) suspected fraudulent activity, (b) violation of the Terms of Service, (c) abuse of the 30-Day Satisfaction Guarantee, (d) inventory or supply constraints, or (e) discontinuation of the relevant product. PawHerb will provide reasonable advance notice (typically by email) and will refund any prepaid amounts attributable to undelivered shipments.
For any dispute arising from a Subscription — including disputes about charges, cancellation timing, or refund eligibility — please contact hello@mypawherb.com before initiating a chargeback or payment dispute with your card issuer. PawHerb is committed to resolving Subscription disputes promptly and in good faith. Disputes that cannot be resolved informally are subject to the binding-arbitration and class-action-waiver provisions set forth in Section 19 of the Terms of Service.
